3131 Reduction in Staff
The Agency may decide to reduce staffing levels in the event that funding for staff positions is not continued, or is reduced, or if a service contract is terminated, or if any other conditions, as determined by the Agency, warrant such action.
In such an instance, the Agency may restructure the existing placement of staff to address Agency needs; however, the Agency reserves the right in each such instance to terminate employment of staff for the purpose of reduction in staff, including during the term of an individual contract.
When such a reduction is necessary, an individual's work performance and ability to carry out assigned responsibilities will be considered as primary factors in determining which staff member will be terminated for the purpose of reduction in staff; other factors may also be considered.
Any such termination for the purpose of reduction in staff shall not be subject to the Grievance Procedure (Policy #3340).
