3435.1 Extended Leave Without Pay

Extended leave without pay is a temporary non-pay status and absence from duty by employee.

The authorization of a leave of absence is a matter of administrative dis­cretion. Employees, with a few exceptions as determined by law, cannot demand that they be granted a leave of absence as a matter of right. Requests for leaves of absence must be presented to the agency administrator after the employee's immediate supervisor has attached a recom­mendation. The Board has final authority to approve leaves of absence.

Each request for a leave of absence should be examined closely to assure the value to CESA 5 or that the needs of the em­ployee are suf­ficient to offset the inconveniences of the Agency.

Except in unusual circumstances, or in furtherance of a program, which requires more time, leaves of absence should not be authorized initially for a period in excess of 52 weeks. Upon return from a leave of absence no credit will be given for salary purposes for the year of experience that an employee gains while on leave. He/she will, however, receive all other rights and benefits which accrue during the absence. If the position that was vacated by the employee is not available when the leave of absence expires, CESA 5 has no obligation to employ the person for that position nor does CESA 5 have an obligation to employ such a person in any other position.
